These Terms & Conditions ("Terms") govern your use of the Tendmory website and its subdomains (*.tendmory.com), the Tendmory Care app, the Tendmory Work app, and the memorial, care-status, and family-communication services (together, the "Services") provided by Cognenti LLC, doing business as Tendmory ("Tendmory," "we," "us," or "our"). By using the Services you agree to these Terms and to our Privacy Policy.
The Services
Tendmory provides software for cemeteries, funeral homes, and crematories ("facilities") to manage records, coordinate services, and keep families informed — including public memorial pages, private care-status pages, and notifications sent by email and text on a facility's behalf. Through the Tendmory Care app, families can order one-time or recurring headstone cleaning, restoration, and grounds care, and follow the status of arrangements.
Accounts & eligibility
- You must be at least 18 to create an account or make a purchase.
- Facility staff accounts are created and managed by the facility. Families sign in to the Care app with a mobile phone number verified by a one-time code.
- You are responsible for the activity under your account and for keeping your sign-in secure.
- You may delete your Care-app account at any time from within the app (Account → Delete account) or by emailing [email protected].
Orders, payments & cancellation
- Payments. Care-app orders and facility subscriptions are processed by our payment provider, Stripe. By placing an order you authorize the charge shown at checkout.
- One-time & recurring care. One-time visits are charged once. Recurring plans bill on the schedule shown (per visit or annually) until you cancel.
- Cancellation. You can pause or cancel a recurring plan at any time from your account; cancellation stops future charges and takes effect at the end of the current period.
- Fulfillment. Care visits are carried out by vetted local crews. Scheduling is confirmed after your order and may vary with weather, cemetery access, and the condition of the memorial.
- Refunds. If a visit cannot be completed, contact us and we will reschedule or refund the affected visit.
Content you submit
Families and visitors may submit content such as tributes, photos, and messages ("Content"). You keep ownership of your Content, and you grant Tendmory and the relevant facility a non-exclusive license to host, display, and use it to provide the Services. You are responsible for your Content and confirm you have the right to share it. Public content (like a memorial tribute) enters a moderation queue and appears only after a facility approves it; we may remove Content that is unlawful, infringing, or disrespectful.
Acceptable use
- Don't use the Services unlawfully, or to harass, impersonate, or infringe others' rights.
- Don't attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services.
- Don't upload malware or scrape data without permission.
Text messaging terms
Tendmory offers an optional informational text-messaging program that sends case and care-status updates, appointment and service reminders, scheduling confirmations, and account notifications on behalf of your facility.
- Consent is voluntary. You are never required to provide a mobile number or agree to texts, and consent is not a condition of any purchase, service, or arrangement. You are opted in only if you affirmatively choose to be — for example, by giving your mobile number and agreeing to receive updates. This includes messages sent by automated means.
- Message frequency varies and depends on the progress of your case or arrangement.
- Message and data rates may apply; charges are billed by your mobile carrier.
- You can opt out any time by replying STOP to any message; you'll get one confirmation, after which no further texts are sent. You can also ask your facility to remove your number.

- Carriers are not liable for delayed or undelivered messages. Supported carriers include major U.S. carriers (AT&T, T-Mobile, Verizon, and their networks); messaging is intended for U.S. numbers.
Third-party integrations
Facilities may connect optional third-party services to their workspace, such as exporting sales to QuickBooks Online. These integrations transmit the facility's data to the third party at the facility's direction and are governed by the third party's own terms (for QuickBooks, Intuit's terms of service). Tendmory is not an accounting, tax, or bookkeeping service: exported records are provided as a convenience, the facility is responsible for reviewing its books and for the accuracy of its accounting and tax filings, and integrations may be interrupted by changes on the third party's side.
Facilities and the work performed
Tendmory provides software and coordination tools. The underlying services — interments, cremations, arrangements, and care visits — are performed by the facilities and crews themselves. Facilities are responsible for the accuracy of the records they enter and for the services they render to families.
Disclaimers & limitation of liability
The Services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Tendmory is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Services will not exceed the amount you paid to Tendmory in the twelve months before the claim.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wyoming.
Changes
We may update these Terms from time to time. We will post the new version and update the effective date above; continued use of the Services after a change means you accept the updated Terms.
